Distance Selling Agreement

1. Parties

This Distance Sales Agreement ("Agreement") is established electronically between SEMFA KOZMETİK GIDA SANAYİ VE TİC. LTD. ŞTİ., located at Yakuplu Mah. Hürriyet Blv. Skyport Sitesi Skyport Residence No:1 İç Kapı No:113 34524 Beylikdüzü / İstanbul, Beylikdüzü VD: 7601122860, Trade Registry No: 1047265, MERSİS No: 0760112286000001, Phone: 0 850 309 33 99, E-mail: info@evolvium.com.tr (hereinafter referred to as "Seller") and the real person ("Buyer") who places an order through the website www.evolvium.com.tr.


2. Subject

The subject of this Agreement is to determine the rights and obligations of the parties within the scope of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale and delivery of food supplement products ordered by the Buyer from the Seller's website.


3. Product and Price Information

The type, quantity, sale price, and payment information of the products are as stated on the order summary page. All prices include VAT. The Seller is not responsible for obvious price errors.


4. Payment and Security

Payment transactions are carried out through the iyzico infrastructure. All transactions are made with 3D Secure verification. Credit card information is not stored by the Seller. The Seller takes the necessary technical and administrative measures for payment security.


5. Delivery

Orders are shipped within 1–2 business days. The delivery time is 1–3 business days throughout Turkey. Shipping is free for orders of 1,000 TL and above. Delivery may be delayed due to force majeure; in this case, the Seller cannot be held responsible.


6. Right of Withdrawal

The Buyer has the right of withdrawal within 14 days from the date of receiving the product. To exercise the right of withdrawal, written notification must be made to the Seller within this period. The product to be returned must be unopened, with its security seal intact, and in a resalable condition. For food supplements, the right of withdrawal cannot be exercised for products with opened packaging due to hygiene regulations. The Seller reserves the right to evaluate within the scope of customer satisfaction.


7. Defective Product

If there is damage during delivery, it is recommended to prepare a report. If the damage is noticed after delivery, notification must be made with a photograph within 24 hours. For defective products, the Buyer is offered product replacement or a refund. The return shipping cost for defective products is covered by the Seller.


8. Agreement on Evidence

The parties accept that in disputes arising from this agreement, the electronic records, database records, and system logs belonging to the Seller shall constitute conclusive evidence within the scope of Article 193 of the HMK (Civil Procedure Law).


9. Resolution of Disputes

In disputes, the İstanbul Consumer Arbitration Committees and İstanbul Consumer Courts are authorized within the monetary limits determined annually by the Ministry of Commerce of the Republic of Turkey.


10. Effectiveness

By confirming the order, the Buyer declares that they have read, understood, and accepted the provisions of this Agreement.
